Don't understand the problem here. There is no competition in the amount of pictures.If Javier has an agreement with the owner of these pics, it's ok for me and for sure it's good for this community.
It's stupid you have to ask a letter to prove you can upload these pictures.
If you uploaded them with another account nobody should ask anything.
First of all, I would lend my support to my friend Javier, I think these pictures are doing a great job himself with the information in the wiki of those boats. I think these photos are worthy of the show by the sheer quality of them to be made by him, but as he says has written permission from the owner. I believe in my humble opinion, that the solution to the problem would be that those photos were accompanied by a comment such as "courtesy of ..." and so would end all these controversies about both bother

It is ok to upload vessel images where users have clearing / agreements / copyrights for. So if you talk to an owner of the photograph and reach an agreement, just give a short description to the image and this will be perfect with the makers of this site.
There are good ways established, to react to copyright frauds quickly. But not every image made from a helicopter or in perfect quality will be in question, only because the average user can't take it that way.
We do have many professional acting photographers at this site. I do not appreciate a cultur of mistunes and distrust. Also, everybody has got a second chance with us....this is an open site, my name is MindOpen.
Hello. the respect I want to comment that Digital Seas is a page dedicated to the world of photography of ships in general, and deserve the best shots, and I will now, il try and get my best shots, and also upload the pictures where it is authorized, in some cases will be the exclusive and you do not like, I can not do anything, I and all my friends will do so, a greeting and that'll be good if you are ill, SANTA CLAUS not leave you beautiful photos.

chan2, I think we have the same feeling. On DS you will only see my pictures. If somebody tells me that I can upload his pictures, I will tell him to start an account.
Javier has his own opinion. It's good that he want to upload pictures from somebody else. It's good for this community. For sure, this is not a contest, just a place to look pictures.
If you upload your pictures or you have to agreement from the owner of the pictures, just upload and share it with us.
OK the rules are laid down now.....
A will still only upload photos that a can stand for ( Taken by Me ). Thats most fair a think, but that is MY opinion

We should leave some options for all of us. I do not believe in black or white situations. Sometimes we have to live with a bit gray too. Lets put some trust into the development, fast reaction is always possible.
I will always prefer images shot by spotters...

@CX9AAW. Are you asking who owns the copyright of each photograph after it has been uploaded to DS? Or are you asking something else? Copyright laws are very complex and differ from country to country, you need to make it very clear as to what you are asking.

When uploading photos to give / share ownership of my photos with SD and thus have rights over it.

Firstly I must say that I am not a legal expert, but it is my understanding that in England, copyright ownership is that of the photographer unless: -
a) The photographer was hired or employed to take the photos in which case the copyright belongs to the person, organisation or company who hired or employed the photographer.
b) If the copyright owner sells or gives away the photograph he may or may not pass copyright ownership to that new owner.
If you, the photographer and copyright holder, uploads a photograph to the www. then you would still be the owner of the copyright unless there was an agreement that the copyright passes to a third party, eg the website.
I do not believe that it is a condition of uploading to this site that would effect your copyright in any way.
Spanish law will be different to English law and as the site is German this will also affect things.
Hope this is some help, but remember this is only my opinion, and I may well be wrong.

What IanJohn has written is,in general as I understand photographic copyright in the UK.However you should understand that when photographs are uploaded to the internet and if the site makes those images downloadable then they become available to anyone in the world to download.These downloaded images then may be used in two ways
1.They may be for personal use and not used in any comercial way for gain or otherwise
2.Thry may be 'stolen'directly for gain either for use as a photographic on,say, a web site (not necessarily financial gain) or the may be offered on to a third party for financial gain.These images will invariably be of high quality.
This is the point where real copyright infringement comes in as someone is making money from your property.However,in this situation we already have potentialy three countries copyright laws involved:-the country of the image owner,the country of the thief and the country of the purchaser.
The chances of obtaining a decision as to your copyright is remote and would be very expensive,as with any litigation the real winners are the lawyers.
The rules,therefore on uploading images to a website are as follows.
Do not upload images that may be valuble to another party or you would not like anyone to have acess to.
Understand that your images will probably copied in some way by another party.
Try to chose a site that blocks downloads.
Accept that if you see your prized image on the front page of a newspaper that there will be no photo cridit nor will the cheque be in the post.
I know it is a cruel world but thats life.If you value an image don't upload it, I accept that every image I upload is efectively lost
I have just carried out an expriment.
If I logout and view the site as a guest the only images I have access to are
1.The latest uploads
2.The two pages of uploads on the Open Space Overview page
3.The one initial image on any vessels page
If I log on I have access to all the above plus any other image on a vessels data page.
However if I then download an image that I know I uploaded at 1.7MB 3711x2472 pixels I have an image of 458k 605x404 pixels.Any image downloaded comes in around this size.
In conclusion I believe that any image downloaded (stolen) from this site would not be comercialy viable

I see what you mean,Javier,The images are clearly stolen from the digital seas site as two of the have the ds logo across them and indeed the image sizes are smaller than the download size from this site.This shows how underhanded the press can be.I am sorry for you that your property has been abused but I fear that any action you take could be long with uncertain results.In the UK we do have some lawyers that work on a 'no win,no fee' basis,if you have the same in Spain it may be worth consulting one if you feel strongly about it
I agree with you ... It is true that we upload pictures that are vulnerable to be stolen. It is true that some people ask your permission for personal use, website or anything else. What I see that some websites use bad photos with copyright with some profit motive and that does not seem right (and I hope that this website is not one of them). That has happened to Javier does not seem right that in a medium like television is using a non-free use picture, because what is, have downloaded from this site without permission. I wonder: do we defend ourselves in these situations?. Greetings.

I sugest you find out more about copyright laws in Spain and then contact these sites and ask for an explanation!
All my images now have copyright notice,my exif allways has had.I don't realy like the notice especialy when it infringes on the ship image,however.....
Question.My copyright notice consists of a copyright symbol,year and my name:should I include an e mail address?

Maybe you can make your copyright a little bit smaller.
You upload your pictures to DS. DS has a copyright policy, however, you as uploader still have final copyright.
I also put my copyright on all my pictures, so I have no problem with it.
